Occasionally disputes arise regarding the
proper distribution of a deceased person’s estate. Such disputes may
involve questions relating to the validity of a particular will (such as
where a will is alleged to be the product of improper influence by one
or more beneficiaries) or the existence of other, contradictory wills.
In addition, even where the correct will is probated, there may be
disputes regarding the proper interpretation of such will. The
attorneys at Parker, Pollard & Brown have substantial experience in this
area of the law and have represented executors, beneficiaries and other
interested parties in will disputes, petitions for aid and guidance and
other will and estate related litigation.
In some instances,
trusts may be established to manage and hold certain assets for named
beneficiaries (including beneficiaries of a deceased person’s estate,
minor children and/or incapacitated persons). In these cases, the
assets of the trust are held and administered by one or more trustees.
From time to time, disputes may arise between beneficiaries and trustees
regarding the proper management or distribution of such assets; and
litigation may ensue. We represent parties in all aspects of such trust
litigation, including the prosecution and defense of claims of breach of
fiduciary duty. Additionally, we represent both trustees and
beneficiaries in litigation regarding the validity and proper
interpretation of particular trust documents and provisions.
